Website Terms
The terms governing your use of this website, www.hrify.co.za. Use of the HRify application itself is governed by the Platform Terms of Use.
1. Introduction
This website, www.hrify.co.za, is operated by TJ Software Solutions (Pty) Ltd ("TJ Software Solutions", "we", "our", or "us"). These Website Terms govern your access to and use of this website. By accessing this website, you agree to be bound by them.
These terms cover the website only. If your organisation subscribes to HRify, your use of the HRify web application and mobile apps is governed by the Platform Terms of Use and by your proposal or agreement with us, and where those say something different from these terms about the application, they prevail.
2. Who operates this website
HRify is an HR and payroll platform that is developed, owned and operated by TJ Software Solutions (Pty) Ltd, a software company registered in South Africa. HRify is a product name, not a separate company. Our full company details are in section 20 and on the legal and company information page.
3. Using this website
You may access and use this website for lawful purposes only. You agree not to:
- Attempt unauthorised access to any system or service.
- Distribute malware, viruses, or harmful code.
- Interfere with website functionality.
- Use automated tools to extract website content without permission.
- Misrepresent your identity when submitting enquiries or requests.
We reserve the right to restrict or terminate access where misuse is identified.
4. Information on this website
Information provided on this website is for general informational purposes only. Descriptions of the product, its features, pricing and functionality may change without notice. Nothing contained on this website constitutes a binding offer unless confirmed through a written proposal, quotation, contract, or agreement.
- Prices. The prices shown are our published rates in South African rand and exclude VAT. They are not an offer. Your price is confirmed in a written quote.
- The price calculator. The calculator gives an estimate on monthly billing from the published rates and the number you enter. It is a guide, and the written quote is what counts.
- Screenshots. The screenshots on this website are taken from the product using a demonstration company. The people, companies and figures shown in them are not real.
- Features and tiers. Which features you receive depends on the tier you subscribe to, as set out on the pricing page and in your proposal.
We take care to keep this website accurate. If you find something on it that you believe is wrong, tell us using the details in section 20 and we will correct it.
5. Not professional advice
This website describes how HRify handles payroll, tax, leave, discipline and data protection under South African law. Those descriptions explain what the software does. They are not tax, accounting, legal, labour or payroll advice, and you should not rely on them as a statement of the law as it applies to you.
- TJ Software Solutions is not a registered tax practitioner, accountant, auditor or law firm.
- There is no SARS certification for payroll software. HRify is not affiliated with, endorsed by or certified by the South African Revenue Service, the Department of Employment and Labour, the CCMA or the Information Regulator.
- An employer who uses HRify remains the party accountable to SARS and to every other authority, and remains responsible for reviewing, filing and paying. Section 17 of the Platform Terms of Use sets this out in full.
6. Demo requests
You may request a demonstration or a quote through this website. Submission of a demo request does not create a contractual relationship between TJ Software Solutions and the requester. We reserve the right to accept, decline, or postpone demonstrations at our discretion.
Please do not put identity numbers, banking details or other people's personal information into the contact form. We do not need them to reply to you.
7. The HRify application and mobile apps
The "Log in" link on this website takes you to the HRify web application, which is a separate service at a separate address. You need an account given to you by an organisation that subscribes to HRify. We do not create accounts for individuals through this website.
The HRify mobile apps are distributed through Google Play and, once approved, the App Store. Downloading an app from a store is also subject to that store's own terms. The apps are of use only to people whose organisation subscribes to HRify.
HRify is proprietary software owned and operated by TJ Software Solutions. Access to it is subject to the Platform Terms of Use, a subscription agreement or a trial arrangement. Platform functionality may evolve over time as improvements and updates are introduced.
8. Intellectual property and trade marks
All content appearing on this website remains the property of TJ Software Solutions unless otherwise stated. This includes the HRify name and logo, branding, graphics, screenshots, documents, software, designs, source code, workflows, documentation and website content.
No content may be copied, reproduced, distributed, modified, reverse engineered, or republished without prior written permission.
What this does not cover. This clause protects what is ours. It does not extend to third-party or open-source components, which belong to their authors and are used under their own licences. Nothing here limits anything the Copyright Act permits regardless of our permission, such as fair dealing or the reproduction of insubstantial parts.
Other people's trade marks. Names such as SARS, e@syFile, Google Play, Apple, iPhone, Face ID, App Store and Microsoft 365 belong to their respective owners. We use them only to describe what HRify works with, and their use does not mean that any of those organisations endorses, certifies or is affiliated with HRify.
9. Links to other websites
This website links to websites we do not control, including the app stores. We are not responsible for the content or the privacy practices of those websites, and you should review their own terms and policies before using them.
10. Availability
We will make reasonable efforts to keep this website available and accurate. However:
- This website is provided on an "as available" basis.
- Website availability is not guaranteed.
- Access may occasionally be interrupted due to maintenance or technical issues.
11. Limitation of liability
To the maximum extent permitted by law, TJ Software Solutions shall not be liable for:
- Indirect damages
- Consequential damages
- Loss of profits
- Loss of business opportunities
- Loss of data
- Operational downtime
- Special or punitive damages
arising from the use of this website or reliance on the general information published on it.
What we never exclude. Nothing above limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for anything else the law does not permit us to limit. Where the Consumer Protection Act applies to you, section 14 of these terms sets out how these limits are affected.
Liability arising from a subscription to HRify is dealt with in section 18 of the Platform Terms of Use, not here.
12. Indemnity
You agree to indemnify and hold harmless TJ Software Solutions, its directors, employees, contractors, and affiliates against any claims, losses, liabilities, costs, or expenses arising from:
- Breach of these terms
- Misuse of this website
- Violation of applicable laws
- Infringement of third-party rights
13. Value-added tax
Our quotations and fees exclude VAT. If we are registered as a VAT vendor when we invoice, VAT is added at the rate in force under the Value-Added Tax Act 89 of 1991 and shown on the invoice.
We will give you at least 30 days' written notice before VAT first appears on your invoices. VAT is never added to work already invoiced.
14. Your rights if the Consumer Protection Act applies
The Consumer Protection Act 68 of 2008 applies to some of our customers and not others. It generally applies where you are a natural person, or a business whose asset value or annual turnover is below the threshold set by the Minister, which is currently R2 million.
If the Act applies to you, then:
- nothing in these terms takes away or reduces any right the Act gives you, and any term that conflicts with the Act does not apply to you to the extent of the conflict;
- sections 5, 10, 11 and 12 limit our risk or place an obligation or risk on you. We have set them out in plain language and in their own numbered sections so that they are drawn to your attention before you agree, as section 49 of the Act requires. Ask us if anything in them is unclear; and
- we will not rely on any term a court would regard as unfair, unreasonable or unjust under section 48.
15. Electronic transactions
You cannot buy HRify through this website. A subscription begins with a written proposal that you accept. The information that section 43 of the Electronic Communications and Transactions Act, 2002 requires a supplier to make available is published on the legal and company information page.
If you are an individual and you subscribe online or by email without meeting us in person, section 44 of that Act gives you a cooling-off right. Section 4A of the Platform Terms of Use explains it.
16. Privacy
Our Privacy Policy explains what personal information we collect through this website and in HRify, and what we do with it. This website sets no cookies and loads no advertising or analytics tags.
17. Governing law
These terms shall be governed by and interpreted in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of South African courts.
18. Changes to these terms
We may change these terms. Changes that do not affect your rights, such as fixing a typo or clarifying wording, take effect when we publish them. The date these terms were last updated is shown at the top of this page, and we keep previous versions available on request. We do not apply changes retrospectively.
19. General
- If one part fails. If a court finds any part unenforceable, the rest continues to apply and that part is read down to the least extent necessary.
- Not waiving our rights. If we do not enforce a term immediately, we do not lose the right to enforce it later.
- Resolving disputes. Tell us first and we will try to resolve it with you directly. This does not stop you approaching the Information Regulator or any other body you are entitled to approach.
- No partnership. Nothing here makes us partners, or either of us the other's agent or employee.
